Juridical Review of the Responsibilities of Land Deed Officials in Making Land Sale and Purchase Deeds

Abstract


Land has always been a fundamental need for human existence and survival. Therefore, the need for land continues to grow along with the development of time and humans, so it is natural that humans always try to get more land, including through buying and selling property. Because the Land Sale and Purchase Deed can only be issued by a Public Official, namely a Notary and PPAT. This study uses a normative juridical method with an empirical sociological approach. Data was obtained through analysis of legal documents and through direct interviews related to Land Deed Making Officials. The analysis was carried out using Jeremy Bentham's Welfare State Theory, Talcot Person's Intermediate Theory, Wida Gdo's Applied Theory and H.D Stoud's Authority Theory as quoted by Ridwan HR From the research results, it is known that PPAT is a general official whose job is to make certain deeds, especially deeds of transfer of land rights as regulated in PP No. 37 of 1998, PPAT is responsible for the deeds it makes both administratively, civilly and criminally. There are several factors that become obstacles or obstacles in carrying out the responsibilities of Land Deed Making Officials (PPAT), namely Complexity of Regulations and Procedures, Ownership Disputes or Disputed Land, Incomplete or Invalid Documentation, Poor Communication with Parties, Time and Volume Limitations Limited Employment and Use of Technology. By identifying these potential obstacles and implementing appropriate solutions, PPAT can improve the quality of service and ensure that the process of making land sale and purchase deeds runs smoothly in accordance with applicable legal standards.
