Penelitian ini menginvestigasi tantangan dan prospek perlindungan Hak Asasi Manusia (HAM) dalam kerangka hukum kenegaraan di era globalisasi. Dalam konteks globalisasi yang semakin kompleks, interaksi antar negara dan aktor non-negara telah membawa tantangan baru dalam memastikan kepatuhan terhadap standar HAM. Tantangan utama termasuk adanya tekanan terhadap kedaulatan negara, penyalahgunaan wewenang oleh pemerintah, dan ketidakadilan dalam sistem peradilan. Namun, terdapat juga prospek yang muncul, seperti peran organisasi internasional dalam mempromosikan standar HAM, kemajuan teknologi yang memfasilitasi koordinasi aktivis HAM, dan munculnya norma-norma baru dalam hukum internasional yang menekankan tanggung jawab perusahaan multinasional terhadap HAM. Dengan menganalisis teori-teori yang relevan dan studi kasus nyata, penelitian ini memberikan pemahaman mendalam tentang dinamika perlindungan HAM di era globalisasi. Berdasarkan temuan tersebut, disarankan untuk memperkuat independensi sistem peradilan, meningkatkan kerja sama internasional, mendorong partisipasi masyarakat sipil, dan mengembangkan kerangka regulasi yang mengikat perusahaan multinasional dalam menjaga HAM. Langkah-langkah ini diharapkan dapat mengatasi tantangan dan memanfaatkan prospek dalam perlindungan HAM di era globalisasi.
