Anti-Dumping dan Countervailing Duty terhadap Produk Baja Tahan Karat dari Indonesia: Tinjauan Hukum Internasional

Bea masuk antidumping adalah pengaturan mengenai pajak yang dikenakan pada barang impor untuk mengkompensasi selisih antara harga ekspor dan nilai normalnya, jika dumping menyebabkan kerugian bagi produsen produk pesaing di negara pengimpor. Countervailing Duty merupakan sebuah tindakan dalam peningkatan bea masuk yang diberlakukan oleh negara pengimport agar supaya dapat menyeimbangi subsidi yang diberikan terhadap negara pengekspor. Pada kasus antara Indonesia dan Uni-Eropa, Indonesia menggugat Uni-Eropa kepada WTO atas pengaturan yang dibuat oleh Uni-Eropa mengenai Bea masuk anti dumping dan Countervailing Duty. Namun menurut Uni-Eropa, mereka mengadakan pengaturan tersebut karena mereka merasa bahwa dalam perdagangan ekspor yang dilakukan oleh Indonesia, Indonesia menerima subsidi dari negara China sebab itu Uni-Eropa merasa perlu menerapkan pengaturan tersebut.
