Perkembangan teknologi informasi dan komunikasi membawa perubahan nyata dalam praktik hubungan masyarakat, khususnya dalam bidang hukum perjanjian. Perjanjian yang sebelumnya, dilakukan secara konvensional dengan tanda tangan basah, berkembang menjadi perjanjian elektronik melalui digital. Penelitian ini bertujuan untuk menganalisis keabsahan perjanjian elektronik tanpa tanda tangan basah berdasarkan Pasal 1320 KUHPerdata, kekuatan pembuktiannya, serta penerapannya dalam praktik hukum di Indonesia. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Teknik pengumpulan data dilakukan secara studi kepustakaan dengan menganalisis bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa perjanjian elektronik tetap sah dan memiliki kekuatan mengikat jika memenuhi unsur kesepakatan, kecakapan, objek tertentu, dan sebab yang halal sebagaimana diatur dalam Pasal 1320 KUHPerdata. Dokumen elektronik diakui sebagai alat bukti hukum yang sah berdasarkan Undang-Undang Informasi dan Transaksi Elektronik.
