Legal Analysis of Abortion and Menstrual Regulation from an Islamic and Positive Law Perspective

This research presents an in-depth analysis of abortion law and menstrual regulation from the perspective of Islam and positive law, as well as integrating the views of ulama. A normative approach is used to explore Islamic teachings regarding the right to life of the fetus, women's rights, and moral norms relating to abortion and menstrual regulation. In addition, from a positive law perspective, this research evaluates medical, ethical and human rights aspects, with a particular focus on the potential integration of menstrual regulation within a positive legal framework. This analysis also includes an in-depth understanding of the views of leading Islamic scholars on these issues, providing insight into the diverse perspectives within Islam. This research highlights the points of contact and differences between Islamic perspectives and positive law, providing a comprehensive picture of the complexity of reproductive health issues. The views of the scholars examined provide an additional dimension in understanding Islamic legal concepts related to abortion and menstrual regulation. It is hoped that the results of this research can provide a basis for thinking and developing policies that are balanced and in accordance with religious values and positive legal principles.
