HKI atau HaKI jika dijabarkan secara lebih detail merupakan suatu hak yang muncul karena adanya pola pikir otak yang kemudian menghasilkan suatu produk maupun jasa yang dapat dimanfaatkan oleh orang lain. Di dalam HKI terdapat ruang lingkup yang salah satunya adalah membahas tentang Hak Merek, Hak merek memiliki pengertian sebagai Hak yang eksklusif diberikan secara legal kepada pemilik suatu produk yang mereknya terdaftar. Walaupun terkesan sederhana akan tetapi kasus putusan hak merek ini ada beberapa yang dapat dikatakan cukup kompleks. Hak merek sendiri juga diatur dalam UU nomor 20 tahun 2016 tentang merek dan indikasi geografis.
