Abstract

Salah satu metode yang populer dan diminati saat ini adalah penyelesaian sengketa melalui arbitrase. Bahkan, pihak-pihak dari negara-negara maju saat ini cenderung untuk tidak menjalin hubungan bisnis tanpa memasukkan klausul arbitrase ke dalam perjanjian mereka. Apabila sengketa dianggap relatif sederhana, maka satu arbiter tunggal akan ditunjuk untuk menangani dan memutuskan perkara tersebut. Jenis penelitian ini adalah penelitian hukum normatif yang bertujuan untuk mengkaji arbitrase sebagai opsi penyelesaian sengketa di luar lingkup pengadilan. Dalam penelitian ini, peneliti melakukan analisis terhadap arbitrase sebagai opsi penyelesaian sengketa di luar pengadilan. Berdasarkan jenis penelitiannya, pendekatan yang akan digunakan adalah pendekatan normatif atau dogmatik hukum sebagai pendekatan utama. Bahan hukum yang digunakan terdiri dari sumber primer dan sekunder.
