Abstract

Pranata hukum waris berperan penting dalam menjaga struktur sosial masyarakat, khususnya dalam masyarakat adat karo yang menganut sistem patrilineal. Dalam sistem ini, anak laki-laki menjadi pewaris utama, sedangkan anak perempuan umumnya hanya menerima warisan simbolis. Namun, dalam masyarakat karo muslim, terjadi pergeseran nilai akibat pengaruh hukum islam yang memberikan hak waris kepada perempuan. Perbedaan prinsip ini menimbulkan dinamika dalam praktik pewarisan dan kedudukan perempuan. Penelitian ini menggunakan metode normatif empiris yang bertujuan untuk menganalisis secara mendalam hak dan kedudukan perempuan dalam pewarisan menurut hukum adat karo dan hukum islam dengan teknik pengumpulan data melalui studi kepustakaan, observasi, wawancara, dan dokumentasi. Data dianalisis melalui reduksi, penyajian naratif, dan penarikan kesimpulan.
