Perlindungan Hak Pekerja Freelance di Era Gig Economy Studi Kasus: Platform Digital Lokal

Perkembangan ekonomi gig di Indonesia telah menciptakan lapisan pekerjaan baru yang berada di luar jangkauan perlindungan hukum konvensional. Studi ini meneliti model regulasi ideal untuk pekerja lepas di era ekonomi gig dan mekanisme penyelesaian sengketa yang efektif antara pekerja lepas dan platform digital lokal. Dengan menggunakan metode penelitian hukum normatif dengan pendekatan kualitatif, hasilnya menunjukkan bahwa kerangka hukum ketenagakerjaan Indonesia tidak mampu mengakomodasi karakteristik unik pekerja platform, seperti subordinasi algoritmik dan ketergantungan ekonomi asimetris. Studi perbandingan dengan Inggris, Spanyol, Amerika Serikat, dan Prancis menekankan perlunya pembentukan kategori hukum baru "pekerja platform" dengan asumsi hubungan kerja, jaminan sosial proporsional, dan transparansi algoritmik. Dalam hal penyelesaian sengketa, pekerja lepas menghadapi berbagai hambatan mulai dari mekanisme internal platform yang tidak imparsial hingga ambiguitas yurisdiksi antara Pengadilan Hubungan Industrial (PHI) dan Pengadilan Negeri. Studi ini menyimpulkan perlunya sistem perlindungan hukum yang responsif, preventif, dan adaptif terhadap dinamika ekonomi digital.
