Abstract

Pembangunan di Indonesia melibatkan masyarakat dan pemerintah untuk kesejahteraan, dengan fokus pada tenaga kerja. Perlindungan tenaga kerja diatur oleh Undang-Undang Cipta Kerja dan program Jaminan Kematian (JKM) dari BPJS Ketenagakerjaan, yang memberikan dukungan finansial kepada ahli waris karyawan yang meninggal. Permasalahan dalam penelitian ini meliputi pengajuan klaim asuransi dan hak ahli waris terhadap klaim asuransi kematian karyawan. Metode penelitian menggunakan pendekatan yuridis normatif dan empiris, melalui studi pustaka dan wawancara. Hasil penelitian menunjukkan bahwa klaim asuransi dimulai dengan pemberitahuan kematian kepada perusahaan asuransi, diikuti pengumpulan dokumen untuk pencairan dana kepada ahli waris. Ahli waris berhak atas pencairan dana sesuai ketentuan polis, termasuk pesangon dan ganti rugi lainnya.
