Penelitian ini bertujuan untuk menganalisis proses penyelesaian gugatan perbuatan melawan hukum dalam sengketa balik nama sertifikat hak milik atas tanah berdasarkan Studi Putusan Nomor:5/Pdt.G/2024/PN Met. Sengketa ini muncul ketika penggugat merasa dirugikan akibat dari tindakan tergugat yang menghalangi proses balik nama sertifikat hak milik atas tanah. Penelitian ini menggunakan pendekatan yuridis normatif dan empiris, dengan pengumpulan data melalui studi Pustaka dan melakukan wawancara dengan pihak terkait. Hasil penelitian ini menunjukan bahwa faktor penyebab gugatan meliputi pelaksanaan transaksi yang tidak sesuai prosedur, kerugian yang dialami penggugat akibat tidak terpenuhinya hak yuridis, serta ketidaklengkapan persyaratan administratif. Proses penyelesaian gugatan dilakukan sesuai dengan hukum acara yang melibatkan beberapa tahapan didalamnya. Dalam putusan nya,pengadilan mengabulkan Sebagian gugatan penggugat dan memerintahkan Turut tergugat untuk melakukan balik nama sertifikat. Penelitian ini menegaskan pentinya kepatuhan terhadap prosedur hukum dalam transaksi tanah untuk mencegah terjadinya sengketa.
