Implementasi Incoterms 2020 Dalam Kontrak Bisnis Internasional Sebagai Perlindungan Hukum Bagi Penjual dan Pembeli

Penelitian ini menganalisis implementasi Incoterms 2020 dalam kontrak jual beli lintas negara sebagai instrumen yang memberikan kepastian hukum sekaligus melindungi kepentingan penjual dan pembeli. Fokus kajian diarahkan pada dua rumusan masalah, yaitu pengaturan serta prinsip-prinsip dasar Incoterms 2020 yang relevan dalam mengatur hak, kewajiban, dan pembagian risiko, serta mekanisme penerapannya agar mampu memberikan perlindungan hukum yang seimbang bagi para pihak. Hasil pembahasan menunjukkan bahwa Incoterms 2020 menegaskan pembagian tanggung jawab secara rinci terkait titik serah barang, peralihan risiko, pembagian biaya, dan kewajiban dokumentasi. Ketentuan ini memungkinkan para pihak memahami kapan risiko berpindah dan siapa yang menanggung biaya tertentu, sehingga meminimalkan potensi sengketa. Mekanisme penerapan Incoterms 2020 dilakukan melalui pemilihan term yang tepat pada tahap negosiasi, pencantuman eksplisit term dan versi 2020 dalam kontrak, serta pemenuhan dokumen pendukung sesuai ketentuan. Integrasi dengan konvensi internasional seperti United Nations Convention on Contracts for the International Sale of Goods (CISG) serta pemanfaatan teknologi digital semakin memperkuat kepastian hukum dan perlindungan kepentingan penjual maupun pembeli. Penelitian ini merekomendasikan peningkatan literasi hukum bagi pelaku usaha, sosialisasi berkelanjutan oleh pemerintah, dan penelitian lanjutan terkait penerapan Incoterms 2020 di berbagai sektor industri. Dengan penerapan yang tepat, Incoterms 2020 berfungsi optimal sebagai pedoman kontraktual yang mendukung terciptanya perdagangan internasional yang adil, efisien, dan memiliki kepastian hukum.
