Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan sebagaimana telah diubah melalui Undang-Undang Nomor 6 Tahun 2023 merupakan landasan hukum yang mengatur perlindungan tenaga kerja di Indonesia, termasuk pekerja magang sebagai bagian dari program pelatihan kerja. Program magang bertujuan untuk meningkatkan kompetensi dan pengalaman praktis, namun dalam pelaksanaannya masih menghadapi berbagai permasalahan, seperti ketidakjelasan status hubungan kerja, keterbatasan perlindungan upah, serta kurang optimalnya jaminan keselamatan dan kesehatan kerja. Kondisi ini menunjukkan bahwa perlindungan hukum terhadap pekerja magang belum sepenuhnya terlaksana secara efektif, yang dipengaruhi oleh lemahnya pengawasan, rendahnya pemahaman perusahaan terhadap ketentuan yang berlaku, serta terbatasnya posisi tawar pekerja magang dalam hubungan kerja. Oleh karena itu, diperlukan upaya penguatan pengawasan dan peningkatan kepatuhan terhadap regulasi guna mewujudkan perlindungan yang lebih optimal bagi pekerja magang di Indonesia.
