Analisis Yuridis atas Dinamika Transaksi Bisnis Internasional dalam Kerangka Hukum Perdagangan Global

Pertumbuhan globalisasi telah mendorong peningkatan aktivitas perdagangan internasional yang melibatkan berbagai pihak dari berbagai negara dengan sistem hukum yang berbeda. Keadaan ini menghasilkan dinamika hukum yang rumit, terutama berkaitan dengan perbedaan yurisdiksi, ketidaksesuaian regulasi, serta kemajuan teknologi digital dalam perdagangan internasional. Studi ini bertujuan untuk menganalisis secara hukum alasan di balik dinamika transaksi bisnis internasional yang menghasilkan masalah hukum serta bagaimana kerangka hukum perdagangan global dapat mengakomodasi dan memberikan kepastian hukum terhadap dinamika tersebut. Metodologi penelitian yang diterapkan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan komparatif, serta memanfaatkan sumber hukum primer dan sekunder. Temuan penelitian menunjukkan bahwa isu hukum dalam transaksi bisnis internasional disebabkan oleh perbedaan sistem hukum, ketidaksetaraan posisi pihak-pihak, lemahnya harmonisasi hukum internasional, serta kemajuan teknologi yang belum sepenuhnya diimbangi dengan peraturan yang memadai. Selain itu, kerangka hukum perdagangan internasional telah berusaha memberikan kepastian hukum dengan melakukan harmonisasi regulasi, penerapan prinsip-prinsip hukum global, serta mekanisme penyelesaian konflik seperti arbitrase, namun pelaksanaannya masih membutuhkan peningkatan. Sehingga, perlu adanya pengembangan sistem hukum yang lebih fleksibel, seimbang, dan adil untuk menghadapi tantangan globalisasi dalam aktivitas bisnis internasional.
