Tantangan dan Prospek Perlindungan Hak Asasi Manusia Dalam Sistem Hukum Tata Negara Indonesia Pasca Reformasi

Kajian ini menganalisis berbagai tantangan serta prospek dalam upaya perlindungan hak asasi manusia (HAM) yang terintegrasi dalam sistem hukum tata negara Indonesia sejak periode pasca reformasi. Secara normatif (das sollen), negara dituntut untuk memberikan jaminan efektif terhadap HAM sebagai bagian integral dari fungsi hukum tata negara. Namun dalam kenyataan empiris (das sein), masih ditemukan berbagai hambatan signifikan dalam implementasinya, termasuk inkonsistensi regulasi di berbagai tingkatan, kelemahan struktural pada lembaga pengawasan, serta tingkat kesadaran publik yang belum optimal. Riset-riset sebelumnya telah menunjukkan bahwa perubahan konstitusional dan reformasi regulasi telah memberikan penguatan terhadap kerangka hukum HAM, namun masih terdapat celah penelitian mengenai bagaimana prospek konkret ke depan dapat direalisasikan untuk memperkuat sistem perlindungan tersebut. Dengan menggunakan pendekatan normatif-yuridis yang dikombinasikan dengan analisis kelembagaan, artikel ini menemukan bahwa penguatan melalui harmonisasi regulasi secara menyeluruh, peningkatan kapasitas kelembagaan lembaga pengawas, dan intensifikasi partisipasi masyarakat sipil menjadi kunci strategis bagi prospek perlindungan HAM di masa mendatang. Hasil kajian ini memberikan kontribusi akademik dalam memahami bagaimana sistem hukum tata negara Indonesia dapat berevolusi menuju penegakan HAM yang lebih efektif dan berkeadilan.
