Urgensi Penguatan Legal Drafting Kontrak Sewa Rumah Online dalam Menjamin Kepastian Hukum Warga Negara

Transformasi digital mendorong perubahan signifikan dalam praktik sewa-menyewa rumah yang kini banyak dilakukan melalui media daring. Meskipun kontrak elektronik telah diakui keabsahannya dalam hukum positif Indonesia, praktik menunjukkan masih terdapat berbagai persoalan seperti ketidakjelasan klausula, lemahnya verifikasi identitas, serta ketidakseimbangan informasi antara pihak penyewa dan pemilik rumah. Penelitian ini bertujuan menganalisis urgensi penguatan legal drafting dalam kontrak sewa rumah online sebagai instrumen untuk menjamin kepastian hukum warga negara. Metode penelitian menggunakan pendekatan yuridis normatif yang didukung teori kepastian hukum Gustav Radbruch dan konsep negara hukum. Hasil penelitian menunjukkan bahwa penguatan legal drafting diperlukan untuk memperjelas substansi klausula, meningkatkan transparansi, serta memperkuat perlindungan hukum dalam transaksi digital. Selain itu, negara memiliki peran penting dalam menyediakan regulasi yang lebih responsif agar prinsip kepastian hukum dapat diwujudkan secara optimal.
