Analisis Pelanggaran Merek Dagang Dalam E-Commerce di Indonesia

Kita hidup di era yang serba digital, di mana perkembangan teknologi informasi dan komunikasi telah mendorong pesatnya aktivitas perdagangan melalui platform elektronik (e-commerce) seperti, Tokopedia, Shopee, dan Bukalapak telah memberikan kemudahan bagi pelaku usaha dan konsumen. Namun, di sisi lain, fenomena ini juga memicu meningkatnya pelanggaran merek dagang, khususnya dalam bentuk penjualan barang palsu, peniruan merek, dan penggunaan merek tanpa izin. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk pelanggaran merek dagang dalam e-commerce di Indonesia serta mengkaji faktor penyebab dan upaya penegakan hukum dalam menghadapi tantangan tersebut. Metode yang digunakan adalah pendekatan yuridis normatif dengan menelaah peraturan perundang-undangan yang telah ditetapkan, diimplementasikan, serta diselaraskan secara berkelanjutan guna mengikuti perkembangan teknologi digital, sehingga sistem hukum nasional tetap relevan dan adaptif dalam memberikan perlindungan terhadap hak atas merek di lingkungan perdagangan elektronik.
