Abstract

Penulisan karya tulis ini bertujuan untuk mengetahui “Hukum Potong Tangan Bagi Pelaku Pencurian” yang ada di Indonesia maupun luar Indonesia tentang penerapan hukum potong tangan dan juga dalil-dalil yang mengemukakan tentang hukum potong tangan tersebut. Adapun latar belakang dari penulian ini adalah perbedaan penerapan hukum pidana yang berlaku pada setiap negara yang mengacu pada hukum Islam. Beberapa pendapat dari para ahli tentang pemikirannya terhadap hukum potong tangan bagi pelaku pencurian. Dengan menggunakan metode penelitian kualitatif deskriptif, hasil penelitian dan pembahasan tentang hukum tangan bagi pelaku pencurian menunjukan bahwa sitem pidana yang diterapkan di Indonesia bagi pelaku pencurian tidak mengacu pada sitem potong tangan, sedangkan di Brunei sendiri beberapa tahun lalu telah memutuskan untuk melaksanakan bertahap pemberlakuan hukum islam, salah satunya adalah potong tangan bagi pelaku penurian.
