Narcotics Eradication Policy from the Perspective of Human Rights Protection

Using normative research methods, this research examines the impact of narcotics eradication policies from the perspective of protecting Human Rights (HAM) where Indonesia faces serious challenges in overcoming the distribution and abuse of narcotics. Although Law Number 35 of 2009 concerning Narcotics provides a legal framework, an overly repressive approach to law enforcement often violates individual human rights, such as the right to fair treatment and adequate recovery. Even though the protection of human rights is regulated in the Indonesian constitution, the reality on the ground often does not match the legal promises. For example, there are cases of human rights violations against narcotics users, which show that the implementation of anti-narcotics policies has not yet achieved a balance between law enforcement and human rights protection. Therefore, this research highlights the importance of a more humane and recovery-oriented approach in narcotics eradication policies to ensure that the human rights of every individual remain protected, in accordance with universal human rights principles.
