Dari Regulasi ke Inovasi: Tantangan dan Peluang Hukum bagi Kewirausahaan Penerbangan Indonesia

Penelitian ini bertujuan untuk menganalisis peran regulasi dan kerangka hukum dalam mendorong pertumbuhan kewirausahaan di sektor penerbangan Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah kualitatif deskriptif, dengan pengumpulan data melalui studi literatur terhadap berbagai peraturan perundang-undangan, kebijakan pemerintah, serta jurnal ilmiah yang relevan. Hasil penelitian menunjukkan bahwa regulasi berperan ganda, yaitu sebagai pengendali keselamatan dan keamanan sekaligus sebagai pendorong inovasi di sektor penerbangan. Regulasi yang adaptif, transparan, dan berbasis risiko mampu mendorong lahirnya wirausaha baru di bidang teknologi penerbangan, digitalisasi layanan, dan inovasi logistik udara. Namun, birokrasi yang panjang, tumpang tindih antarinstansi, serta peraturan yang belum fleksibel masih menjadi hambatan utama bagi pelaku usaha untuk berinovasi. Peluang reformasi hukum, seperti penerapan regulatory sandbox, digitalisasi perizinan, dan kerja sama publik-swasta, dinilai dapat memperkuat ekosistem kewirausahaan di bidang penerbangan. Dengan demikian, regulasi yang pro-inovasi dan kolaboratif akan menjadi landasan penting bagi terwujudnya sektor penerbangan Indonesia yang kompetitif, efisien, dan berdaya saing global.
